JERRY HARVEY AUDIO RESPONDS TO PATENT TRIAL BOARD DECISION
 
ORLANDO, FL, July 21, 2017 - For decades, Mr. Jerry Harvey has been the pioneer of in-ear monitors worn by the world's leading performing artists, including U2, Madonna, Justin Timberlake, Maroon 5, Aerosmith, Guns N’ Roses, Van Halen, Lady Gaga, Foreigner, Alicia Keys, Rob Thomas, Garth Brooks, Stevie Wonder, Mick Jagger and others. 
 
Recognizing his continued innovation in the field, the Patent Office has granted Mr. Harvey several patents for his inventions, which have also received overwhelming public acclaim from customers and the media. This week, the Patent Office's Trial Board ruled against just one of Jerry Harvey Audio's patents, despite admitting Mr. Harvey's invention was new. Jerry Harvey Audio respects the Patent Trial Board, but strongly disagrees with its decision and is considering its rights to seek both reconsideration and appeal. 
 
The Patent Trial Board is well known to be hostile to patent owners, as even the former Chief Judge of the Court of Appeals in Washington, D.C., that oversees the Patent Trial Board has called it a "patent death squad." Because of its well known anti-patent bias, there is pending legislation in Congress to overhaul the Patent Trial Board and make it more fair to patent holders. The Supreme Court has also recently taken a case asking whether the Patent Trial Board's actions are even constitutional, since they take away patent rights without giving patent owners a fair hearing.
 
64 Audio is a recent entrant to the IEM market that from its inception has copied Mr. Harvey's inventions (even the name 64 Audio is a blatant copy of JH Audio). This is why Mr. Harvey has had to reluctantly go to court to enforce his patents against 64 Audio, something he's never done before to any other company. To date, 64 Audio has infringed four of JH Audio's patents and this week's Patent Trial Board decision only affects one of them. It does not affect the three other JH Audio patents that 64 Audio is infringing or any of JH Audio's several other patents or patent applications.

"I'm disappointed that the Patent Trial Board ruled against one of my many patents this week, but the process is far from over and I am confident it will ultimately result in my patent being upheld. In the interim, I'm going to stay focused on serving our customers and continuing to make the world's best and most innovative IEMs."
